This Agreement Describes The Terms And Conditions Of Use Between Softbeads Pvt. Ltd. Developer Of Fareonn Mobile Application And Website, A Company Incorporated Under The Companies Act 1956 And Having Its Registered Office As At 301,Ratan Residency,7/87,Tilak Nagar, Kanpur- 208001, Uttar Pradesh, India Cin- U72900up2019ptc122219 (Here By Referred As “Fareonn”,“We”, “Our” And “Us”) And Anyone Who Has Installed And Uses Fareonn Application Including But Not Limited To The Consignor, Transporter, Vehicle Provider, Driver And Agent. For The Purpose Of The Terms And Conditions Of Use And Wherever The Context So Requires, The Terms “User” And “User(S)”, Shall Mean Any Person Who Uses The Fareonn Application Or Website Or The Service In Any Manner. By Using The Fareonn Application Or Website Or The Service, User(S) Agrees To Comply With These Terms And Conditions Of Use. Besides, When Using A Portion Of The Service, User(S) Agree To Conform To Any Applicable Posted Guidelines For Such Service, Which May Change Or Be Updated From Time To Time At Our Sole Discretion. User(S) Understand And Agree That User(S) Are Solely Responsible For Reviewing These Terms And Conditions Of Use From Time To Time. Should User(S) Object To Any Of These Terms And Conditions Of Use, Any Guideline, Or Any Subsequent Changes Thereto Or Become Unhappy With The Use Of Fareonn Mobile Application, Website Or The Service In Any Way, User(S) Only Choice Is To Immediately Discontinue Use Of The Fareonn Mobile Application And Website And The Service.

2. Description Of Service And Content Policy

  • A. Fareonn Is The Next Generation Of Online Marketplace For Transportation Of Goods. We Acts As A Medium For User(S) To Negotiate And Interact With Other User(S) For Entering Into Negotiations In Respect Thereof For Arranging And Scheduling Transportation, Logistics And/Or Delivery Services. User Must Acknowledge That Their Ability To Obtain Transportation, Logistics And/Or Delivery Services Through The Use Of The Application Does Not Establish Fareonn As A Provider Of Transportation, Logistics Or Delivery Services Or As A Transportation Carrier. Fareonn Is Not A Party To Any Negotiations That Take Place Between The User(S) Of The Application And Are Further Not Parties To Any Agreement Concluded Between The User(S) Of The Application.
  • B. User(S) Must Acknowledge That Fareonn Does Not Control, And Is Not Responsible For Ads, Directory Information, Business Listings/Information, Messages Between Users, Including But Not Limited To Message Sent, Load Posted, Vehicle Posted, Files, Images, Photos, Video, Sounds, Business Listings/Information And Directory Information Made Available Through The Application And Website. User(S) May Be Exposed To Content That Is Offensive, Indecent, Inaccurate, Misleading, Or Otherwise Objectionable. User(S) Acknowledge And Agree That He Is Responsible For And Must Evaluate, And Bear All Risks Associated With, The Use Of Any Content, That User(S) May Not Rely On Said Content, And That Under No Circumstances Will Fareonn Be Liable In Any Way For The Content Or For Any Loss Or Damage Of Any Kind Incurred As A Result Of The Browsing, Using Or Reading Any Content Listed, Or Otherwise Made Available Via Fareonn. User(S) Acknowledge And Agree That Fareonn Cannot And Does Not Pre-Screen Or Approve Any Content, But That Fareonn Has The Right, In Its Sole And Absolute Discretion, To Refuse, Delete Or Move Any Content That Is Or May Be Available Through The Fareonn, For Violating These Terms And Conditions Of Use, Such Violation Being Brought To Fareonn’s Knowledge Or For Any Other Reason Or No Reason At All.
  • C. User(S) Acknowledge And Agree That User(S) Are Solely Responsible For Their Own Content Posted On, Transmitted Through, Or Linked From Their Account In Fareonn And The Consequences Of Posting, Transmitting, Linking Or Publishing It. More Specifically, User(S) Is Solely Responsible For All Content That User(S) Upload, Or Otherwise Make Available Via Fareonn. In Connection With Such Content Posted On, Transmitted Through, Or Linked From The Fareonn By User(S), User(S) Affirm, Acknowledge, Represent, Warrant And Covenant That: (I) User(S) Own Or Have And Shall Continue To, For Such Time The Content Is Available On Fareonn, Have The Necessary Licenses, Rights, Consents, And Permissions To Use Such Content Posted On Fareonn Including But Not Limited To All Patent, Trademark, Trade Secret, Copyright Or Other Proprietary Rights In And To Any And All Such Content And Authorize Fareonn To Use Such Content To Enable Inclusion And Use Of The Content In The Manner Contemplated By Fareonn In These Terms And Conditions Of Use And (Ii) User(S) Should Have The Written Consent, Release, And/Or Permission Of Each And Every Identifiable Individual Person Or Business In The Content To Use The Name Or Likeness Of Each And Every Such Identifiable Individual Person Or Business To Enable Inclusion And Use Of The Content In The Manner Contemplated By Fareonn In These Terms And Conditions Of Uses. For Clarity, User(S) Retain All Of His Ownership Rights In His Content; However, By Submitting Any Content On Fareonn, User(S) Hereby Grant To Fareonn An Irrevocable, Non-Cancellable, Perpetual, Worldwide, Non-Exclusive, Royalty-Free, Sub-Licensable, Transferable License To Use, Reproduce, Distribute, Prepare Derivative Works Of, Display, And Perform The Content In Connection With Fareonn Business, Including Without Limitation For The Purpose Of Promoting And Redistributing Part Or All Of The Fareonn And Content Therein (And Derivative Works Thereof) In Any Media Formats And Through Any Media Channels Now Or Hereafter Known. These Rights Are Required By Fareonn In Order To Host And Display User(S) Content. Furthermore, By User(S) Posting Content To Any Public Area Of The Service, User(S) Agree To And Do Hereby Grant To Fareonn All Rights Necessary To Prohibit Or Allow Any Subsequent Aggregation, Display, Copying, Duplication, Reproduction, Or Exploitation Of The Content On The Fareonn By Any Party For Any Purpose. User(S) Also Hereby Grant Each User Of Fareonn A Non-Exclusive License To Access User(S) Content Through The Fareonn. The Foregoing License To Each User Granted By User(S) Terminates Once User(S) Or Fareonn Remove Or Delete Such Content From The Fareonn.
  • D. Fareonn Does Not Endorse Any Content Or Any Opinion, Statement, Recommendation, Or Advice Expressed Therein, And Fareonn Expressly Disclaims Any And All Liability In Connection With User Content. Fareonn Does Not Permit Copyright Infringing Activities And Infringement Of Intellectual Property Rights On The Application, And Fareonn May, At Its Sole Discretion, Remove Any Infringing Content If Properly Notified In Accordance With Applicable Law That Such Content Infringes On Another's Intellectual Property Rights. Fareonn Reserves The Right To Remove Any Content Without Prior Notice. Fareonn May Also Terminate A User's Access To The Application And Website, If They Are Determined To Be A Repeat Infringer Or Found To Be Indulging In Any Act Contrary To These Terms And Conditions Of Use. A Repeat Infringer Is A User Who Has Been Notified Of Infringing Activity More Than Twice And/Or Has Had A User Submission Removed From The Application More Than Twice. Further, At Its Sole Discretion, Fareonn Reserves The Right To Decide Whether Any Content Is Appropriate And Complies With These Terms And Conditions Of Use.

3. Conduct

User(S) Agree Not To Post, Host, Display, Upload, Modify, Publish, Transmit, Update Or Share Any Information On Fareonn, Or Otherwise Make Available Content:
  • 1. That Violates Any Law Or Regulation;
  • 2. That Is Copyrighted Or Patented, Protected By Trade Secret Or Trademark, Or Otherwise Subject To Third Party Proprietary Rights, Including Privacy And Publicity Rights, Unless User(S) Is The Owner Of Such Rights Or Have Permission Or A License From Their Rightful Owner To Post The Material And To Grant Fareonn All Of The License Rights Granted Herein;
  • 3. That Infringes Any Of The Foregoing Intellectual Property Rights Of Any Party, Or Is Content That User(S) Do Not Have A Right To Make Available Under Any Law, Regulation, Contractual Or Fiduciary Relationship(S);That Is Harmful, Abusive, Unlawful, Threatening, Harassing, Blasphemous, Defamatory, Obscene, Pornographic, Paedophilic, Libellous, Invasive Of Another's Privacy Or Other Rights, Hateful, Or Racially, Ethnically Objectionable, Disparaging, Relating Or Encouraging Money Laundering Or Illegal Gambling Or Harms Or Could Harm Minors In Any Way Or Otherwise Unlawful In Any Manner Whatsoever;
  • 4. That Harasses, Degrades, Intimidates Or Is Hateful Towards Any Individual Or Group Of Individuals On The Basis Of Religion, Gender, Sexual Orientation, Race, Ethnicity, Age, Or Disability;
  • 5. That Violates Any (Local) Equal Employment Laws, Including But Not Limited To Those Prohibiting The Stating, In Any Advertisement For Employment, A Preference Or Requirement Based On Race, Colour, Religion, Sex, National Origin, Age, Or Disability Of The Applicant.
  • 6. That Threatens The Unity, Integrity, Defence, Security Or Sovereignty Of India, Friendly Relations With Foreign States, Or Public Order Or Causes Incitement To The Commission Of Any Cognisable Offence Or Prevents Investigation Of Any Offence Or Is Insulting Any Other Nation;
  • 7. That Includes Personal Or Identifying Information About Another Person Without That Person's Explicit Consent;
  • 8. That Impersonates Any Person Or Entity, Including, But Not Limited To, An Fareonn Employee, Or Falsely States Or Otherwise Misrepresents An Affiliation With A Person Or Entity;
  • 9. Deceives Or Misleads The Addressee About The Origin Of Such Messages Or Communicates Any Information Which Is Grossly Offensive Or Menacing In Nature;
  • 10. That Is False, Deceptive, Misleading, Deceitful, Miss-Informative, Or Constitutes "Bait And Switch" Offer;
  • 11.That Constitutes Or Contains "Pyramid Schemes," "Affiliate Marketing," "Link Referral Code," "Junk Mail," "Spam," "Chain Letters," Or Unsolicited Advertisements Of A Commercial Nature;
  • 12. That Constitutes Or Contains Any Form Of Advertising Or Solicitation If (1) Posted In Areas Or Categories Of The Website And Mobile Application Which Are Not Designated For Such Purposes; Or (2) E-Mailed Or Message To Fareonn Users Who Have Requested Not To Be Contacted About Other Services, Products Or Commercial Interests;
  • 13. That Includes Links To Commercial Services Or Third Party Websites, Except As Specifically Allowed By Fareonn;
  • 14. That Advertises Any Illegal Services Or The Sale Of Any Items The Sale Of Which Is Prohibited Or Restricted By Applicable Law, Including Without Limitation Items The Sale Of Which Is Prohibited Or Regulated By Applicable Law;
  • 15. That Contains Software Viruses Or Any Other Computer Code, Files Or Programs Designed To Interrupt, Destroy Or Limit The Functionality Of Any Computer Software Or Hardware Or Telecommunications Equipment Or Any Other Computer Resource;
  • 16. That Disrupts The Normal Flow Of Dialogue With An Excessive Number Of Messages (Flooding Attack) To Fareonn, Or That Otherwise Negatively Affects Other Users' Ability To Use Fareonn; Or
  • 17. That Employs Misleading Mobile No. And Email Address, Otherwise Manipulated Identifiers In Order To Disguise The Origin Of Content Transmitted Through The Service.
Additionally, User(S) Agree Not To:
  • I. Contact Anyone Who Has Asked Not To Be Contacted, Or Make Unsolicited Contact With Anyone For Any Commercial Purpose, Specifically, Contact Any User To Post Advertisement On A Third Party Website Or Post Any Advertisement On Behalf Of Such User; Or To "Stalk" Or Otherwise Harass Anyone;
  • II. Make Any Libellous Or Defamatory Comments Or Postings To Or Against Anyone;
  • III. Collect Personal Data About Other Users Or Entities For Commercial Or Unlawful Purposes;
  • IV. Use Automated Means, Including Spiders, Robots, Crawlers, Data Mining Tools, Or The Like To Download Or Scrape Data From The Service, Except For Internet Search Engines And Non-Commercial Public Archives That Comply With Our Robots.Txt File;
  • V. Post Content That Is Not Relevant, Repeatedly Post The Same Or Similar Content, Or Otherwise Impose Unreasonable Or Disproportionately Large Loads On Our Servers And Other Infrastructure;
  • VI. Attempt To Gain Unauthorized Access To Computer Systems And Application Owned Or Controlled By Fareonn Or Engage In Any Activity That Disrupts, Diminishes The Quality Of, Interferes With The Performance Of, Or Impairs The Functionality Of Fareonn.
  • VII. Use Any Form Of Automated Device Or Computer Program (Sometimes Referred To As "Flagging Tools") That Enables The Use Of Fareonn's "Flagging System" Or Other Community Control Systems Without Each Flag Being Manually Entered By A Human That Initiates The Flag (An "Automated Flagging Device"), Or Use Any Such Flagging Tool To Remove Posts Of Competitors, Other Third Parties Or To Remove Posts Without A Reasonable Good Faith Belief That The Post Being Flagged Violates These Terms And Conditions Of Use Or Any Applicable Law Or Regulation.
  • VIII. Use Any Automated Device Or Software That Enables The Submission Of Automatic Postings On Fareonn Without Human Intervention Or Authorship (An "Automated Posting Device"), Including Without Limitation, The Use Of Any Such Automated Posting Device In Connection With Bulk Postings, Or For Automatic Submission Of Postings At Certain Times Or Intervals; Or Any Content Uploaded By User(S) Shall Be Subject To Relevant Laws And May Disabled, Or And May Be Subject To Investigation Under Appropriate Laws. Furthermore, If User(S) Is/Are Found To Be In Non-Compliance With The Laws And Regulations, These Terms And Conditions Of Use, Or The Privacy Policy, Fareonn May Terminate That Account/Block Access To Fareonn. Fareonn Reserve The Right To Remove Any Non-Compliant Content Uploaded By User(S).

4. Access To Service And Registration

The Use Of Fareonn Service Requires User(S) To Register. If User(S) Register, User(S) Agree To Provide True, Accurate, Current And Complete Information About Themselves As Asked In Our Registration Form And Be Responsible For The Use Of His Account In Fareonn Application .

5. Notification Of Claims Of Infringements

Fareonn Is Not Liable For Any Infringement Of Copyright Arising Out Of Materials Posted On Or Transmitted Through Fareonn, Or Items Advertised On Fareonn, By End Users Or Any Other Third Parties. If User(S) Are An Owner Of Intellectual Property Rights Or An Agent Who Is Fully Authorised To Act On Behalf Of The Owner Of Intellectual Property Rights And Believe That Any Content Or Other Content Infringes Upon Their Intellectual Property Right Or Intellectual Property Right Of The Owner On Whose Behalf User(S) Are Authorised To Act, User(S) May Submit A Notification To Fareonn Together With A Request To Fareonn To Delete The Relevant Content In Good Faith. The Notification And The Request Must Contain The Following Information:
  • 1. A Physical Or Electronic Signature Of A Person Authorized To Act On Behalf Of The Owner Of An Exclusive Right That Is Allegedly Infringed;
  • 2. Identification Of The Intellectual Property Rights Claimed To Have Been Infringed, Or, If Multiple Intellectual Property Rights At A Single Online Site Are Covered By A Single Notification, A Representative List Of Such Works At That Site;
  • 3. Identification Of The Content (By Means Of Data Or Communication Link, Ad Id, Etc.) That Is Claimed To Be Infringing Or To Be The Subject Of Infringing Activity And That Is To Be Removed Or Access To Which Is To Be Disabled And Information Reasonably Sufficient To Permit Fareonn To Locate The Material;
  • 4. Information Reasonably Sufficient To Permit Fareonn To Contact User(S), Such As An Address, Telephone Number, And, If Available, An Electronic Mail Address;
  • 5. A Signed Statement That User(S) Have A Good Faith Belief That Use Of The Material In The Manner Complained Of Is Not Authorised By The Intellectual Property Right-Owner, Its Agent, Or The Law;
  • 6. A Signed Statement That The Intellectual Property-Owner Hold Fareonn Harmless From Any Claim Of Any Third Party In Connection With The Removing By Fareonn Of The Relevant Content; And
  • 7. A Signed Statement That The Information In The Notification Is Accurate And Under Penalty Of Perjury That User(S) Are Authorised To Act On Behalf Of The Owner Of An Exclusive Right That Is Allegedly Infringed.

6. Intellectual Property Rights

User(S) Acknowledge And Agree That The Materials On Fareonn, Other Than The User Content That User(S) Licensed Under Section 2(C) Of The Terms And Conditions Of Use, Including Without Limitation, The Text, Software, Scripts, Graphics, Photos, Sounds, Music, Videos, Interactive Features And The Like ("Materials") And The Trademarks, Service Marks And Logos Contained Therein. Materials On Fareonn Are Provided To User(S) As Is For Their Information And Personal Use Only And May Not Be Used, Copied, Reproduced, Distributed, Transmitted, Broadcast, Displayed, Sold, Licensed, Or Otherwise Exploited For Any Other Purposes Whatsoever Without The Prior Written Consent Of The Respective Owners. Fareonn Reserves All Rights Not Expressly Granted Herein To User(S) Agree To Not Engage In The Use, Copying, Or Distribution Of Any Of The Materials Other Than As Expressly Permitted For Any Commercial Purposes. If User(S) Download Or Print A Copy Of The Materials For Personal Use, User(S) Must Retain All Copyright And Other Proprietary Notices Contained Therein. User(S) Agree Not To Circumvent, Disable Or Otherwise Interfere With Security Related Features Of Fareonn Or Features That Prevent Or Restrict Use Or Copying Of Any Materials Or Enforce Limitations On Use Of Fareonn Or The Materials Therein. The Service Is Protected To The Maximum Extent Permitted By Copyright Laws And Other Laws. Content Displayed On Or Through Fareonn Is Protected By Copyright As A Collective Work And/Or Compilation, Pursuant To Copyrights Laws And Other Laws. Any Reproduction, Modification, Creation Of Derivative Works From Or Redistribution Of Fareonn, The Materials, Or The Collective Work Or Compilation Is Expressly Prohibited. Copying Or Reproducing The Fareonn, The Materials, Or Any Portion Thereof To Any Other Server Or Location For Further Reproduction Or Redistribution Is Expressly Prohibited. User(S) Further Agree Not To Reproduce, Duplicate Or Copy Content Or Materials From Fareonn, And Agree To Abide By Any And All Copyright Notices And Other Notices Displayed On Fareonn. User(S) May Not Decompile Or Disassemble, Reverse Engineer Or Otherwise Attempt To Discover Any Source Code Contained In Fareonn. Without Limiting The Foregoing, User(S) Agree Not To Reproduce, Duplicate, Copy, Sell, Resell Or Exploit For Any Commercial Purposes, Any Aspect Of Fareonn. Fareonn Is A Word Mark And Logo Registered With The Trade Marks Registry, India.

7. User Submissions

User(S) Understand That When Using Fareonn, User(S) Will Be Exposed To Content From A Variety Of Sources, And That Fareonn Is Not Responsible For The Accuracy, Usefulness, Safety, Or Intellectual Property Rights Of Or Relating To Such Content And User Agree And Assume All Liability For Their Use. User(S) Further Understand And Acknowledge That User(S) May Be Exposed To Content That Is Inaccurate, Offensive, Indecent, Or Objectionable, Defamatory Or Libellous And User(S) Agree To Waive, And Hereby Do Waive, Any Legal Or Equitable Rights Or Remedies User(S) Have Or May Have Against Fareonn With Respect Thereto.

8. Indemnity

User(S) Agree To Defend, Indemnify And Hold Harmless Fareonn, Its Officers, Subsidiaries, Affiliates, Successors, Assigns, Directors, Officers, Agents, Service Providers, Suppliers And Employees, From And Against Any And All Claims, Damages, Obligations, Losses, Liabilities, Costs Or Debt, And Expenses (Including But Not Limited To Attorneys' Fees) Arising From: (I) User(S) Use Of And Access To Fareonn; (Ii) User(S) Violation Of Any Term Of These Terms And Conditions Of Uses; (Iii) User(S) Violation Of Any Third Party Right, Including Without Limitation Any Copyright, Trademark, Trade Secret Or Other Property, Or Privacy Right; Or (Iv) Any Claim That User(S) Content Caused Damage To A Third Party. This Defense And Indemnification Obligation Will Survive Termination, Modification Or Expiration Of These Terms And Conditions Of Use And User(S) Use Of Fareonn.

9. No Spam Policy

User(S) Understand And Agree That Sending Unsolicited Communications To Fareonn Email Addresses Or Through Fareonn Computer Systems Are Expressly Prohibited By These Terms And Conditions Of Use. User(S) Acknowledge And Agree That From Time To Time Fareonn May Monitor Email/Chat Usage Using Human Monitors Or Automated Software To Flag Certain Words Associated With Spam Or Scams In Emails /Chat That Are Sent Between One User To Another In The Fareonn Email/Message System. Any Communication Between User(S) And Any Other User Utilizing The Communication Features Available On The Fareonn May Be Used Only In Accordance With The Terms And Conditions Of Use. Any Unauthorized Use Of Fareonn Computer Systems And Mobile Application Is A Violation Of These Terms And Conditions Of Use And Certain Applicable Laws. Such Violations May Subject The Sender And His Or Her Agents To Civil And Criminal Penalties.

10. Dealings With Organizations And Individuals

User(S) Acknowledge And Agree That Fareonn Shall Not Be Liable For User(S) Interactions With Any Organizations And/Or Individuals Through Fareonn. This Includes, But Is Not Limited To, Delivery Of Goods And Services, And Any Other Terms, Conditions, Warranties Or Representations Associated With Any Interaction User(S) May Have With Other Organizations And/Or Individuals. These Dealings Are Solely Between User(S) And Such Organizations And/Or Individuals. User(S) Agree And Acknowledge That Fareonn Shall Not Be Responsible Or Liable For Any Loss Or Damage Of Any Sort Incurred As The Result Of Any Such Dealings Or Interactions. If There Is A Dispute Between Participants Of Fareonn, Or Between Users And Any Third Party, User(S) Understand And Agree That Fareonn Is Under No Obligation To Become Involved In Such Disputes. In The Event That User(S) Have A Dispute With One Or More Other Users, User(S) Hereby Release Fareonn, Its Officers, Employees, Agents And Successors From Any And All Claims, Demands And Damages (Actual And Consequential) Of Every Kind Or Nature, Known Or Unknown, Suspected And Unsuspected, Disclosed And Undisclosed, Arising Out Of Or In Any Way Related To Such Disputes And/Or Our Service.

11. Limitation And Termination Of Service

User(S) Acknowledge And Agree That Fareonn May Establish Limits From Time To Time Concerning Use Of Fareonn, Including Among Others, The Maximum Number Of Days That Content Will Be Maintained Or Retained By Fareonn, The Maximum Number And Size Of Postings, Messages, Or Other Content That May Be Transmitted Or Stored By Fareonn, And The Frequency With Which User(S) May Access Fareonn. User(S) Acknowledge And Agree That Fareonn Has No Responsibility Or Liability For The Deletion Or Failure To Store Any Content Maintained Or Transmitted By The Website Or The Mobile Application Or The Service. User(S) Acknowledge And Agree That Fareonn Reserves The Right At Any Time To Modify Or Discontinue The Fareonn (Or Any Part Thereof) With Or Without Notice, And That Fareonn Shall Not Be Liable To User(S) Or To Any Third Party For Any Such Modification, Suspension Or Discontinuance Of The Service. User(S) Acknowledge And Agree That Fareonn, In Its Sole And Absolute Discretion, Has The Right (But Not The Obligation) To Delete Or Deactivate Their Account, Or Otherwise Terminate User(S) Access To Or Use Of The Service (Or Any Part Thereof), Immediately And Without Notice, And Remove And Discard Any Content Within Fareonn, For Any Reason Or No Reason At All, Including, Without Limitation, If Fareonn Believes That User(S) Have Violated These Terms And Conditions To Use. Further, User(S) Agree That Fareonn Shall Not Be Liable To User(S) Or Any Third-Party For Any Termination Of Their Access To The Website, Mobile Application Or The Service. Further, User(S) Agree Not To Attempt To Use The Service After Any Such Termination.

12. Disclaimer Of Warranties

15. Ability To Accept Terms Of Service

Fareonn Is Intended Only For Adults And That User(S) Are Eligible To Contract As Per Applicable Laws. If User(S) Are Using/Accessing Fareonn As A Representative Of Any Person/Entity, User(S) Acknowledge That User(S) Are Legally Authorised To Represent That Person/Entity.

16. General Information

These Terms And The Other Policies Posted On The Website And Mobile Application Constitute The Complete And Exclusive Understanding And Agreement Between User(S) And Fareonn And Govern User(S) Use Of The Mobile Application, Services And The Website Superseding All Prior Understandings, Proposals, Agreements, Negotiations, And Discussions Between The Parties, Whether Written Or Oral. If Any Provision Of The Terms And Conditions Of Use Is Found By A Court Of Competent Jurisdiction To Be Invalid (Including, Without Limitation, Because Such Provision Is Inconsistent With The Laws Of Another Jurisdiction) Or Inapplicable, The Parties Nevertheless Agree That The Court Should Endeavour To Give Effect To The Parties' Intentions As Reflected In The Provision. Any Failure To Act By Fareonn With Respect To A Breach By User(S) Or Others Does Not Waive Our Right To Act With Respect To Subsequent Or Similar Breaches By User(S) Or Others. User Understand And Agree That, Because Damages Are Often Difficult Or Impossible To Quantify, If Actual Damages Cannot Be Reasonably Calculated Then User Will Be Liable To Pay Fareonn The As Liquidated Damages (And Not A Penalty) As Specified By Fareonn.

The Parties To This Agreement Hereby Submit To The Exclusive Jurisdiction Of The Courts Of Kanpur, Uttar Pradesh, India.

  • Headings For Any Section Of The Agreement Are For Reference Purposes Only And In No Way Define, Limit, Construe Or Describe The Scope Or Extent Of Such Section.
  • The Accepting Of Load/Vehicle By The Vehicle Provider/Consignor Respectively, Is At The User(S) Own Discretion And Understanding. User(S) Expressly Agree That The Company Is In No Way Responsible For Any Untoward Incident Arising Out Of Such Acceptance.
  • It Is The Responsibility Of The Consignor To Get Their Goods Insured And Generate The E-Way Bill Prior To Transporting Them.
  • Vehicle Provider Must Have All The Necessary Registered Documents As Per The Indian Law For Providing Transportation Services.
  • Consignor Before Loading Should Verify Documents Including But Not Limited To, Registration Certification Of Vehicle With Owner Name, Chassis No., Engine No., Driving License Of Driver And Proper Goods Receipt Of A Registered Transporter, Registered Under Goods And Vehicle Act.
  • User (Consignor And Vehicle Provider) Must Mark The Goods As Delivered Once The Goods Are Delivered At Their Destination.
  • We Do Not Retain User(S) Messages In The Ordinary Course Of Providing Our Services To The User(S). Once The Load Is Marked Delivered Or The Load Get Expired User Messages (Including User(S) Chats, Photos, Files, And Shared Location Information) Are Deleted From Our Servers, Further We Do Not Retain User(S) Messages For Long Time.
  • User(S) Will Be Solely Responsible To Assume All Risks For Any Consequences Arising Out Of The Content Shared Through Our Mobile Application And Website. User(S) Expressly Agree That In Case Of Dispute Between User(S), Fareonn And/Or Its Affiliates Are Under No Obligation To Become Involved In Such Disputes, Or Provide Any Data Whatsoever As Evidence, Or Appear Before Any Court Of Law For Settlement Of Such Disputes.
